User consent & data usage policy

USER CONSENT & DATA USAGE POLICY

You have the option of uploading Your identifiable health information and Sensitive personal data or information, including but not limited to physical, physiological and mental health condition, and medical records and history on the Application, which may be accessed by us and/or any of our HSPs* or Third parties, using the Application, during the course of providing Services to You.

(* “Healthcare Service Providers” or “HSPs” are our hospitals or clinics, also includes their duly qualified doctors, Registered Medical Practitioners, nurses, paramedical staff, physiotherapists, consultants, medical equipment suppliers, laboratory service providers, phlebotomist, pharmacist other incidental and ancillary healthcare service providers, our Authorized representatives and who interacts with Users as part of the Services and our Affiliates / Group Companies. Further, the HSPs shall also include Third parties, being the technical support and license providers, who provide their software/licensed software, technical and data storage/management related support providers and call centre support for directly or indirectly providing the services contemplated under this facility. Accordingly all such parties shall be referred herein as “HSPs.”)

If You are an Attendant or Caregiver or Secondary User, information of Primary User and/or Your information may be provided to Us, by using and accessing the Application and Services, if and only if you have been authorized by the Primary User to do so.

By continuing to access and use the Application and Service:

  • You consent to the use of telephonic and/or electronic communications (including audio, and written communications) through any media, by our staff, doctors and our representatives, to contact you using the contact information provided to us by you and to provide our services to you remotely;
  • You authorize us/HSPs to call on the contact number made available by you. You further declare that, irrespective of your contact number being registered on National Customer Preference Register (NCPR) or on National Do Not Call Registry (NDNC), any call made or SMS sent in response to your request shall not be construed as an Unsolicited Commercial Communication, even though the content of the call may be for the purposes of providing information about us, our services or for appointment and consultation.
  • You confirm that You have agreed to provide Your information to us and on the basis of information provided to us, our staff, team of doctors and/or HSPs would further deal with and provide the online services.

We may collect various personal information from You, when You use the Application and for the features provided by the Application.

Our Telemedicine Policy and Privacy Policy, also sets out further additional terms, with respect to the collection, storage, use, processing, transfer and disclosure of any such personal information. The information to be shared on Personal data, can also be used for the purpose of Medical Research and Data analytics, with the aim of providing better a Patient care and Services.

When You click on the ‘I accept’ tab at the time of registering or access the Application or otherwise provide Your personal information, You specifically consent to the terms mentioned here and also to our Our Privacy Policy & Terms of Use.

Further, in case a Health worker, RMP or a Caregiver initiates the Telemedicine consultation, an Explicit consent is required to be obtained. And for this purpose, Your Consent is also deemed to be recorded, When You click on the ‘I accept’ tab at the time of registering or access the Application or otherwise provide Your personal information, You specifically consent to the terms mentioned here and also to our Our Telemedicine Policy, Privacy Policy & Terms of Us.

We/HSPs may disclose/transfer Your Personal Information, in accordance with applicable law and for the purposes, as set out hereunder and also as mentioned in the Telemedicine Policy and Privacy Policy.

We are required by law, to maintain the privacy and confidentiality of Your medical information. We assure to take Your privacy seriously and to maintain privacy and confidentiality of the information provided by You to Us, in accordance with the extant Law.

 

OTHER WEBSITES/MOBILE APPLICATIONS

You may be provided with links on the Application that direct You to third party websites/applications/content or service providers (collectively “Third Party Content”).

Links to such third party applications are provided for Your convenience only. Please exercise Your independent judgment and prudence when visiting/using any Third Party Content via a link available on the Application.

Should You decide to click on the links to visit such Third Party Content, You do so on Your own volition. Your usage of such Third Party Content is subject to the terms of use of the respective Third Party Content and we are not responsible for Your use of any Third Party Content.

We do not make any warranty or give any security with respect to the personal information disclosed by You, using any other external mobile apps/device..

 

DATA RECORDING, STORAGE, ENCRYPTION & USAGE

 

The information stored on the Application, may be entered by You or by Your Attendant/Caregiver, in the course of services provided by us.

The information collected as part of the Services may be stored on our internal and/or third-party cloud platform (“Cloud Service Provider”) or server (“Storage Service Provider”).

All video-consultations/IM chat consultations/text messages/audios/videos/transcripts/prescriptions/email/medical records and hard copy correspondences, between Users and Us/HSPs, shall be recorded, saved and stored for record purposes and in the event such records are required to be produced as evidence on the direction of a court of law. We/our HSPs may review this data from time to time, for quality evaluation purposes.

It is hereby clarified that We/HSPs donot have the obligation to pre-screen or monitor User Content at any time, except as required under Law.

However, We may elect to monitor any User Content and may modify or remove any User Content from the Application, without any intimation, if it is determined that such User Content is in violation of this Agreement or any applicable law and best practices.

All User Content shall be recorded, saved and stored electronically on a secure cloud database/server managed internally and/or by the Cloud Service Provider/Storage Service Provider. We shall take best efforts to ensure that the internal storage/and or Cloud Service Provider/Storage Service Provider uses appropriate levels of encryptions to protect data and takes all necessary precautions. We will however not be responsible for any cyber data t loss or data heft from its Application or the Cloud Service Provider’s/Storage Service Provider’s databases, for the reasons beyond our control, including on account of any Force majeure and despite implementing the standard security systems and protocols in this regard.
